  1. USER INFORMATION

Who is responsible for processing your personal data?

ATLANTE GESTIÓN FINANCIERA, S.L (hereinafter “ZELSIOR”), hereinafter, RESPONSIBLE, informs the USER that it has created profiles on the social networks Facebook, Instagram, Twitter, LinkedIn, Youtube, Vimeo, and Google+, and that it is responsible for processing the personal data of the user that is carried out on these social networks and informs that these data will be processed in accordance with the provisions of Regulation (EU) 2016/679 of April 27 (GDPR), and Organic Law 3/2018, of December 5 (LOPDGDD), therefore the following information about the processing is provided:

Why do we process your personal data?

Purpose of processing: to maintain a relationship between the USER and the RESPONSIBLE which may include the following operations:

  • Process requests and inquiries submitted to the responsible party
  • Inform about activities and events organized by the responsible party
  • Inform about products or services offered by the responsible party
  • Interact through the official profiles

What is the legal basis for processing your personal data?

Legal basis of processing: Article 6.1.a GDPR, the data subject has given consent for the processing of their personal data for one or more specific purposes. The USER has a profile on the same social network and has decided to join the RESPONSIBLE’s social network thus showing interest in the information published there, so at the moment of requesting to follow our official profiles, they provide consent for the processing of personal data published on their profile.

The USER can access at any time the privacy policies of the social network itself, as well as configure their profile to ensure their privacy.

The RESPONSIBLE has access to and processes the public information of the USER, especially their contact name. These data are only used within the social network itself and will only be incorporated into a file of the RESPONSIBLE when necessary to process the USER’s request.

How long will we keep your personal data?

Data retention criteria: they will be kept while the USER does not revoke the consent given as indicated in this privacy policy.

To whom do we provide your personal data?

Data communication: the information provided by the USER through the RESPONSIBLE’s social networks, including personal data, may be published, always depending on the services the USER uses, and may be publicly available to other third-party social network users. From each social network profile, the USER can configure what information to make public in each case, see the permissions granted, remove or deactivate them, like any third-party application they no longer wish to use.

No communication of personal data to third parties outside the social network is foreseen unless it is essential for the development and execution of the purposes of processing, to our communication service providers, with whom the RESPONSIBLE has confidentiality contracts and data processor agreements required by current privacy regulations.

What are your rights?

Rights granted to the USER: they can only be satisfied in relation to the information under the control of the RESPONSIBLE.

  • Right to withdraw consent at any time
  • Right of access, rectification, portability, deletion of data, and limitation or opposition to processing
  • Right to file a complaint with the supervisory authority (www.aepd.es) if you consider that the processing does not comply with current regulations

  1. PROFILE USAGE

The RESPONSIBLE will carry out the following actions:

  • Access public information of the profile
  • Publish on the USER’s profile all information already published on the RESPONSIBLE’s social network
  • Send personal and individual messages through the social network channels
  • Status updates of the page that will be published on the USER’s profile

The USER can always control their connections, delete content that no longer interests them, and restrict with whom they share their connections; for this, they must access their privacy settings.

  1. PUBLICATIONS

Once the USER is a follower or has joined the RESPONSIBLE’s social network, they may publish comments, links, images, photographs, or any other type of multimedia content supported by it. The USER must always be the owner of the published content, hold the copyright and intellectual property rights, or have the consent of the third parties involved.

Any publication on the social network, including texts, graphics, photographs, videos, etc., that attack or are likely to attack morality, ethics, good taste, or decorum, and/or infringe, violate, or breach intellectual or industrial property rights, image rights, or the law is expressly prohibited.

In these cases, the RESPONSIBLE reserves the right to immediately remove the content without prior notice and may request the permanent blocking of the USER.

The RESPONSIBLE is not responsible for content freely published by a USER.

The USER should be aware that their publications will be visible to other users, so they are mainly responsible for their privacy.

Images published on the social network will not be stored in any file by the RESPONSIBLE but will remain on the social network.

  1. DATA OF MINORS OR PERSONS WITH SPECIAL CAPACITIES

Access and registration through the RESPONSIBLE’s social networks are prohibited for minors. If the USER has special capacities, intervention by the holder of parental authority or guardianship, or their legal representative with valid documentation proving representation is required.

The RESPONSIBLE is expressly exempt from any liability arising from the use of social networks by minors or persons with special capacities. The RESPONSIBLE’s social networks do not knowingly collect any personal information from minors; therefore, if the USER is a minor, they must not register, use the RESPONSIBLE’s social networks, or provide any personal information.
